UN Libya commission says government forces have committed war crimes

Three person commission appointed by UN Human Rights Council to investigate violence in Libya published its 92 page report yesterday. The report says that government forces in Libya have committed crimes against Humanity and war crimes under the orders of the Libyan leader Mummar Gaddafi and other high profile leaders of the Libyan Government. The report accuses Libyan Government of committing crimes against humanity such as acts constituting murder, imprisonment, and other severe deprivations of physical liberties, torture, forced disappearances, and rape being part of a widespread attack against civilian population with knowledge of the attack. Commission also says in the report that there is strong evidence of War Crimes committed in violation of the Rome statute. Report published by the commission also lays down that continuous pattern of violations identified in Libya gives way for formulating an inference that these violations were carried out as a result of policy decisions taken by the Gaddafi led government. Estimates in the report show that 10,000–15,000 have been killed since civilian protests against the government in Libya began in February.

A plea to indict Tata and Ambani rejected

Plea rejectedThe Delhi high court on thursday rejected a plea to indict Ratan Tata and Anil Ambani in the 2G spectrum case. The judge along with imposing a fine of Rs.10,000 also said that the case lacks any substance and is not in compliance with law. He added that these kind of cases wastes a lot of court’s precious time and should be strongly condemned with hefty fines. The petition claimed that the CBI knowingly are not looking into the matter and are protecting the persons. It requested the court’s direction to the CBI to indict them. This is not the first time a court has slapped a fine on a third party to the case. On May 25 there was a similar case where it requested the inclusion of companies like Airtel and S-Tel of corrupt practices and the court levied a fine of Rs.10,000 on the petitioner.

Supreme court warns high court not to summon government officials

Warnning about officialsThe High court judges were warned by the apex court that, they should not summon the Government officials for unnecessary reasons as it will result in causing disastrous effect on their governance. The court passed this order when it was found to be improper that even after continuous advise from the apex court, of not summoning the Government officials except in exceptional cases, the Allahabad High Court summoned the U.P government’s principal health secretary for non-compliance of its 21year order. The bench clearly stated that a large number of cases are charged against these officials which are only for the ego satisfaction of the judges. Adding up to the same it was said that the judges of higher judiciary (High Court and Supreme Court) should have high degree of modesty and humility and should not possess any kind of ego problems. Also the court advised the judges to show respect to these officials of the executive. A mutual respect between the executive and the judiciary is an important phenomenon without which the whole system will collapse.
