Legal Hurdles over Lavasa city

lava_flowsThere is a lot of hue and cry over the Lavasa hill city project in Pune Maharashtra. There has been many issues of violations of laws, but the environment minister Jairam Ramesh has strongly came up to say that complete clearance to this city has not been granted by the environment ministry. According to him there are 5 pre conditions which need to be fulfilled by the project authority.  A large scale agitation is being carried out by the National Alliance of Peoples Movement led by Medha Patkar; their agitation is backed by many documentary evidences obtained through RTI. There has been a large scale violation of the environmental laws in this area. There has been violation of the hill station regulation laws as well.  The land here has been acquired by the company from the tribal through middlemen which is strictly prohibited by the law. And not only that the company has acquired ceiling lands as well which were distributed to the land less tribals out here in the Lavasa hill area.

SC Rejects Kanimozhi’s Bail Plea For third time

kanimozhiA special bench division of the Supreme Court on Monday rejected the bail plea of the DMK MP Kanimozhi and Kalaignar TV MD Sajjan Kumar in the 2G spectrum scam case. Though the Supreme Court provided that she can move to the trial court afresh for filing charges for the bail again and the rejection of her bail plea by the Supreme Court will not affect the decision of the trial court. The Apex court also provided that section 437 of the Criminal Procedure Court provides for grant of bail for women in cognizable offenses.It was alleged that Kanimozhi and Sharad Kumar received a bribe of Rs 200 crore from Cineyug Films through Shahid Balwa’s DB Realty.

The deadlock over Lokpal bill

anti corruption billThe Lokpal bill has been brought before the parliament previously for almost 6 times. But it bill failed to take the shape of an act. The current Lokpal bill led by Anna Hazare is lying in deadlock due to some obvious reasons. First of the entire Lokpal bill drafted by the government states that the Lokpal will not have any sue motto powers and it cannot take complaints directly from public. The complaint should be forwarded by the chairman of Loksabha or Rajya sabha. But, this is being opposed by team Anna as to the Lokpal should have sue motto powers and they should be able to take complaints directly from public .If this is not taken care then Lokpal will be always effected by the ruling party.  Secondly, according to government Lokpal should be an advisory body and should work in co-ordination with the competatent authority. On the other hand team Anna doesn’t want Lokpal to be an advisory body, as if such will be the case then prime minister will never allow initiating action against himself.

MIRCHPUR DALIT KILLINGS VERDICT OUT: 15 OUT 97 ACCUSED CONVICTED

A local court in Delhi convicted only 15 out of 97 accused of burning alive a 70 year old man and his 17 year old physically challenged daughter in the village of Mirchpur in Haryana last year. 82 accused were acquitted in the past hearing. Additional SeMirchpur_Dalits_killingsssions Judge Kamini Lau, however, did not held guilty either of the 15 accused on charges of murder. The court held the 15 accused guilty on the grounds of arson, rioting while the main conspirators consisting of Kulwinder, Ramphal and Rajender were convicted under Section 304 (culpable homicide not amounting to murder) of the IPC for setting ablaze the house of Tara Chand on April 21.

Anna Hazare served with Supreme Court notice for misuse of funds

Anna HazareThe Supreme Court on Monday sent a notice to anti corruption crusader Anna Hazare seeking response to the public interest litigation filed by lawyer M L Sharma. The petition asked for a CBI investigation to find more on alleged misuse of funds received from the government for rural development as per the report of Justice Sawant Committee in 2005. The bench comprising Justices Aftab Alam and Ranjana P Desai had issued notices to the Centre and Maharashtra government apart from Anna Hazare. Sharma pointed out in his petition that Hind Swaraj Trust, a public trust had been floated by Anna Hazare and his associates in village Ralegan Siddhi in 1995 with a capital of just Rs 500. Even before the trust was registered the centre had contributed Rs 45 lakh towards the trust for 1994-95 followed by Rs 65.85 lakh from the state government for 1995-96. Sharma alleged that this amounted to criminal breach of trust related to public funds and fraud as it is not possible for a trust that was not even formed to spend that much amount within a short span of time. Anna Hazare had received around one crore rupees from Council for Advancement of People’s Action and Rural Technology in the name of rural help. The level of consumption of these funds received from the consolidated fund of India, could be revealed only after an investigation.
