The Supreme Court blames Government for 2G Scam

Court blame Government in 2GA bench comprising Justice G. S. Singhvi and Justice H. L. Dattu on Thursday,13th October faulted Govt. for the 2 G Scam. They were hearing the bail pleas of two corporate executives of Unitech Wireless Pvt. Ltd and Swan Telecom nam, Sanjay Chandra and Vinod Goenka , the accused in 2G Scam case and said that the Government could have avoided the scam if they had acted according to the letter by Prime minister dated November 2, 2007 directing the allocation to be done through auction. It is clear from the correspondence between the prime minister and the then telecoms minister Raja, that decision of the telecoms department to decline the auction mode had been informed earlier itself. It could have been possible to take a decision even after Raja had issued the Letters of Intent (LoI) on January 10 as the allocation had been completed much later. The Additional Solicitor General Raja who was opposing the bail pleas said that charges against the accused would have stayed the same even though interference would have prevented the further execution.

Prashant Bhushan attacked in his SC Chamber – an attack on Indian Democracy

PPrashant-Bhushanrashant Bhushan, the lawyer activist of Team Anna had been attacked on Wednesday, 12th October in his Supreme Court chamber, leaving the nation in shock. He was getting ready for a TV interview when three people dressed in lawyer’s gown barged into his chamber and assaulted him. The assaulter had entered the chamber claiming they had got prior appointment. Mr Bhushan had been immediately taken to hospital. After condemning right wing, Sri Ram Sene for the assault on him, Bhushan insisted a ban on such organizations that exercise goondaism.

The Supreme Court suspended Kasab’s death sentence

Kasab death sentenseThe Supreme Court on Monday stayed the death sentence of Ajamal Kasab, the accused in 26/11 Mumbai attacks for the reason that his plea challenging the capital punishment has to be heard in detail as due process of law has to be followed. The petition was filed by Kasab through jail authorities. The apex court has appointed an amicus curie, Raju Ramachandran, to assist the case and agreed that the matter will be dealt expeditiously. The case will be heard regularly from January 31, 2012.

Government to release recordings of Lokpal proceedings

lokpal audio tapeThe Government on Sunday has agreed to make the audio recordings of JanLokpal drafting committee meetings available to public. With this move the debate between the government and Anna Hazare’s team will be out in the public domain after a month the parliament finally decided to enact an effective Lokpal. This will bring transparency and restore people’s faith in the government. However sources say that only selective portion of committee proceedings will be exhibited. Elements not encroaching on the jurisdiction or working of the Parliamentary Standing Committee presently analyzing the bill will be made available whereas nothing that will embarrass the government will be made public.

Raja’s plea to attend SC hearing rejected

A RAJAThe plea of former Telecom minister A.R.Raja, an accused in the 2G scam to appear before the court to support his counsel during the hearing on October 10, 2011 was rejected by a special CBI O P Saini on Friday. The plea was rejected as the Supreme Court has not handed out any requisition concerning Raja’s production before it and without such direction it is not possible for the accused as a person in judicial custody to be allowed to be present in that court.

Non Legal Practitioners can represent Consumers before Fora – Supreme Court

A   three- Judge bench of the SC in a recent ruling said that that the privilege of advocates to represent the consumer in the District, state and national Fora is not a matter of right. It was for the court to carefully discern and articulate the legislative intent of an act.  . The legislature conferred this permission to authorised agents as most of the cases in consumer forums being petty litigation’s sans legal intricacies, involving poor litigants who cannot afford heavy professional fees to advocates. In the appeals filed by G.Venkatachalam  and Bar council of India  against  a Bombay High Court Judgment, the basic issue considered was ‘ Whether  a person under the cover of being an “ agent”  could represent a large number of parties before the forums there by frustrating objects embodied in The Advocate’s Act.?’

Sanjiv Bhatt sent on judicial custody

The Suspended IPS officer Sanjiv Bhatt had been sent to judicial custody on Saturday by the Ahmedabad rural court. The police had asked for the custody of Sanjiv Bhatt for 7 days but the court decided that he shall be sent on judicial custody for 15 days. The Court had taken the view that police remand is unnecessary as what the police were looking for is already on the files of Gujarat High Court and Supreme Court. The court is expected to hear the bail application on Monday.  Most of the charges issued against Bhatt are billable. He was charged for causing wrongful restraint and confinement under Section 341 and 342 respectively, for giving fabricating under section 195 and for threat of injury to public servant under Section 189.

Supreme Court allows export of Endosulfan

endosulfanTaking into consideration the contractual obligations of the manufacturers of Endosulfan Supreme Court on September 30th Friday has allowed the export of 1090.596 tonnes of endosulfan. The ban imposed on the production of the pesticide  will continue  as the same is not taken away by this order. A three judge bench comprising Chief Justice S.H. Kapadia and Justices K.S.Radhakrishnan and Swatanter Kumar  issued this direction after  examining the report by an expert committee which indicated an export order for 1734 tonnes of endosulfan ‘technical’ and ‘292.5 KL of formulation’,  that the manufactures were holding. The Court instructed that enough precaution had to be taken in packaging the banned pesticides for its safe export and directed the customs, Insecticide Board and excise authorities to monitor the packaging and transport of the consignment to the concerned ports.
