SC Rejects Kanimozhi’s Bail Plea For third time

kanimozhiA special bench division of the Supreme Court on Monday rejected the bail plea of the DMK MP Kanimozhi and Kalaignar TV MD Sajjan Kumar in the 2G spectrum scam case. Though the Supreme Court provided that she can move to the trial court afresh for filing charges for the bail again and the rejection of her bail plea by the Supreme Court will not affect the decision of the trial court. The Apex court also provided that section 437 of the Criminal Procedure Court provides for grant of bail for women in cognizable offenses.It was alleged that Kanimozhi and Sharad Kumar received a bribe of Rs 200 crore from Cineyug Films through Shahid Balwa’s DB Realty.

Kanimozhi and other eminent personalities including A raja and Bollywood producer Karim Morani therefore, now must now have to spend their days in jail as it now seems before the trial court hears their bail plea again. Karim Morani’s  bail plea was also rejected on Thursday by the delhi high  court as he claimed a bail on health grounds as his lawyers informed the court that he have undergone an angioplasty and he came to the court wearing a neck brace. It was accused by the CBI that Morani’s Cineyug Films Ltd   facilitated the Rs.200 Crores illegal transaction to Kanimozhi’s Kalainagar TV which was actually termed as a bribe though Kanimozhi still maintains that it was loan which was availed at market rates that it was duly repaid. In its second chargesheet, CBI had explained the transaction that Swan Telecom and Dynamix Realty Promoters Shahid Usman Balwa and Thus, Kanimozhi’s lawyer Ram Jethmalani had earlier asked for a bail citing reasons as her motherhood but that actually fell into deaf ears as the judges of the trial court and the Delhi high court didn’t quite sympathize with that. Vinod Goenka channeled Rs 200 crore to Kalaignar TV, through Kusegaon Fruits and Vegetables Pvt Ltd and Morani’s Cineyug Films Pvt Ltd.

Kanimozhi was cited saying that it was a mistake on part of the Delhi High Court to reject her bail plea and that she was only charged with conspiracy but not for being a facilitator for illegal distribution of spectrum licenses and have never abused her power of authority. However, the CBI have so far claimed that  chances of both Kanimozhi and Sharad Kumar  hampering with the evidence against them if both of them gets bail can’t be ruled out as both of them possess strong political connections.
