JUSTICE DELAYED IS JUSTICE DENIED

JUSTICEBapi Adhikari, is finally freed from the jail after 9 years of imprisonment after him being awarded a life imprisonment for murder case – despite of him being a juvenile. The Agartala bench of Guwahati High Court overturned the decision of the lower court and granted freedom to Adhikari who is now in his mid-twenties to whom justice had been denied.

The law clearly lays down that a person below the age of 18 years has to be tried by the Juvenile Board and can serve a maximum three year sentence.

But in the instant case Bapi Adhikari was not even 16yrs when he was sentenced for the murder of Apan Paul and dissatisfied with the court’s decision advocate Ratan Datta, had moved the review petition in the High Court. Datta also stated that it was surprising to know that the then additional district and sessions judge of West Tripura conducted the trial who was supposed to be placed before the Juvenile Justice Board.

And as it is known that justice delayed is justice denied and here after serving his 9yrs of imprisonment finally the High Court has rejected the validity of the original trial.
