Justice Nirmal yadav to face trials in corruption case

Justice Nirmal yadav (retrd) justice of Punjab and Haryana high court has been facing charging of corruption. The high court dismissed her petition dismissed her petition seeking quashing of President of India’s sanction to prosecute her in a corruption case.

The high court ruled that Merely because the petitioner has enjoyed one of the highest constitutional offices, she cannot claim any special right or privilege as an accused than prescribed under law.

With this order of high court she will be facing trials held by the CBI court in the corruption charges against her. High court said that she had very right to ask for the documents which are not produced in the charge sheet from the trial court.

The counsel of Justice Nirmal Mr. K.T. Tulsi contended that once the then Chief Justice of India (CJI), K G Balakrishanan had denied sanction for prosecution, the present CJI had no power to review the earlier decision and grant a fresh sanction.
On this the counsel of CBI contended saying that CBI has sufficient materials to prove her alleged involvement in corruption.
