Project’s Legality of UID: Notices Issued

UID Notices IssuedIn Bangalore the Unique Identification authority of India (UIDAI) gets the legal jerks and jolts. According to V.K.Somasekhar, founder-trustee of Grahak Shakti and Mathew Thomas, a retired Army officer of Citizen’s Action forum, has issue notices to UIDAI Chairperson and Planning Commission Chairperson.

Notice contains that National identification authority of India’s (NIAI) draft bill that seeks to give statutory status to UIDAI has not been yet implemented as it has already spent Rs.3,000 crore and an projected expenditure of Rs.1.5 lakh crore  has been allotted for five years.

According to section (2) of section (3) of the said bill there is provision of to issue the Aadhaar number. Moreover, as the Act omes into force subject to the notification of Central government in the gazette, B T Venktesh , advocate said that without having any legal authority, the authorities have entered contracts with different companies. According to Somasekhar of Grahak Shakti there is “invasion of privacy” which means that the data of a person is personal and has every right to deny access.

Hence, as per the saying that there is “invasion of privacy” the Aadhaar application form takes a declaration from applicants allowing sharing of personal data collected. He said further “by this there is violation of Right to Life and liberty.
