illegitimate Child Considering a new approach into the living relationship of the people and the legitimacy of the children born out of that relationship, the apex court made a declaration that those children should not be regarded as illicit. The court also adds up in its ruling that these kids undoubtedly possess the right to inherit the property of either of their parents. The bench of Justice P. Sathasivam and B.S chauhan stated that a man and a women living together for a certain period of years under the same roof must be presumed to be husband and wife and children born to them in that relationship are not at all illegal or unlawful. The bench again stated that the law presumes in favour of marriage and against concubine and the relationship is regarded to be marriage as per law, if the partners keep their bonding alive for an elongated period of time.

High Court issues notice to centre regarding over crowding in Tihar

Tihar jail crowdingDelhi HC had issued a notice to the centre and the city governments upon a PIL seeking a policy to reduce the number of inmates who are under trials for petty offenses. The PIL said the most percentage of inmates are under trials and this has lead to the over crowding of the high security prison. The petition was filed asking for a policy framework upon such issues like releasing of prisoner who are imprisoned for offenses such as cheating and forgery on bail. The petition also said that the constitutional rights of these under trials are being violated and is an injustice to such persons being imprisoned based on administration of laws and rules. The court also sent a notice to the Director General of the Jail to file a response addressing the issue. The case becomes more interesting as the lawyer who filed the petition Vijay Aggarwal also represents some of the accused from the recent 2G scam who are also imprisoned in Tihar Jail. Many question are raised bringing up the case at this juncture than before when over crowding was always a problem.

Iran parliament votes to send Ahmadinejad to court

Over the law makers say in violation of constitution the Iran parliament has voted to refer president mahmoud Ahamadinejad to the judiciary. Its unclear whether there will be a lawsuit against Ahmadinejad, Wednesday’s vote in parliament shows the majority of Iranian lawmakers are siding with the Guardian Council – the country’s constitutional watchdog body – in an ongoing controversy with the president. The legislators voted 165-1 in favor of legal action against Ahmadinejad over his move last month to declare himself caretaker oil minister after he sacked Masoud Mirkazemi under a Cabinet reshuffle plan.A parliament report says Ahmadinejad’s action was in “obvious violation of the constitution.” Remaining lawmakers in the 290-member assembly were either absent or abstained.

Yugoslav War crimes court to arraign Mladic on Friday

Judges of the Yugoslav war crimes tribunal have scheduled Ratko Mladic’s arraignment for Friday, Mladic was earlier extradited from Serbia to the U.N. court. Dutch Judge Alphons Orie signed the order for arraignment on Wednesday, after the former Bosnian Serb military chief spent his first night in an isolation cell. At the hearing which is scheduled for Friday, Mladic will be asked to enter pleas to 11 charges, including genocide, for allegedly masterminding Bosnian Serb atrocities throughout the 1992-95 Bosnian war.

Public sector lender Central Bank of India entered into a tie-up with broking house Angel Broking to offer on-line trading services platform to its customers. This platform allows the bank’s customers to trade online, and manage all the three accounts–Deposit, Demat and Trading with a single online interface. The customers have the choice of selecting on-line trading, mobile trading or a dealing facility through the phone.

Government allows FDI in LLPs

The Central Government has allowed the Foreign Direct Investment (FDI) in Limited Liability Partnerships though it would be in a calibrated manner with specific condition. As per the new guidelines, FDI in LLPs will be permitted only in the sectors where 100 percent FDI is allowed through automatic route and will not be allowed in agricultural and plantation industries. These new rules will apply after the new consolidated FDI policy is announced.

Supreme Court to examine the delay in mercy petitions

Supreme Court of IndiaThe Supreme Court of India has taken up the question that if there is inordinate delay in disposing mercy petition before the president then the death sentence can be commuted to life imprisonment. This becomes very importance at this time when the mercy petition of Afsal Guru who was convicted for the parliamentary attacks in 2006 is still pending before the president. So it will be interesting to see what is court’s stand on the issue and would serve as a strong precedent for Afsal Guru’s case. Earlier the petitioners have said that they have spent more than a decade in solitary confinement waiting for the decision from the president which never came and has pleaded before the court that their death penalty must be commuted to life imprisonment.

European Union to modernize IP laws

The European Union has urged for better Intellectual property laws by centralizing it. EU had announced this stating that reforms are very much needed to protect against internet piracy, fake products ranging from car parts to health products. The EU feels the present IPR regime is outdated and needs to be modernized for better effectiveness and consumer protection.
