Today Supreme Court noticed on High Court Judge’s Bias’s. Justices Sharma and R.N. Chandrakar declared that “None of us has pre- judged the matter against any party nor any of us is biased in the case from any angle. Suryakant Tiwari one of the accused in Jaggi murder case was convicted by the trial court, applied in the High Court but on obtaining the information from RTI about Justice Sharma’s involvement in the case before becoming judge, so he gave an application for the disqualification of the judge in this present matter but the application was dismissed by the bench.

He appealed to the Supreme Court for the same application. Tiwari’s council and Senior Advocate Mukul Rohatgi said that the petitioner was not alleging any personal interest but he filled this application as he felt that there was reasonable likelihood bias from Justice Sharma against the petitioner in this present case. After hearing the decision of Mukul Rohatgi, the bench of Justice Altamas Kabir, and S.S. Nijjar on Friday issued a notice to the Chhattisgarh government seeking its response on Tiwari’s petition.

In this report Suryakant Tiwari had claimed party with Amit Jogi, who was free from all the charges against him made by the CBI and he was acquitted from the court also, while Jaggi son’s filled a petition in the High Court against this decision. All these appeals are been heard together by a HC bench headed by Justice Sharma.

While rejecting the application of Suryakant Tiwari against the disqualification of Justice Sharma in present case, the High Court bench cited the judgment of Apex court in R.K. Anand’s case and said that the disqualification of judges generally made with the intent to intimidate the court or to get better of an ‘inconvenient’ judge or to obfuscate the issues or to cause obstruction and delay the proceedings or in any other way to frustrate or obstruct the course of justice.
