LACK OF SECURITY MEASURES UNDER SEC 43(a) OF IT ACT ATTRACTS HUGE LIABILITY
The organizations maintaining sensitive and personal information are required to take reasonable security measures as laid down under Section 43(a) of the INDIAN IT AMENDMENT ACT 2008. The section mandates the personal information which identifies a person like passport, credit card, pan card, driving license should be protected.

The confidentiality of the information is lost when such information is leaked. So, the proper steps should be taken to protect such information. Recently, a famous hotel in had made available the various personal details like credit card numbers, photo id’s like passport , driving licenses on its website which could viewed by all the persons accessing the site. The proper security practices were not taken, where the sensitive information of various customers could be exposed to risk.

The cyber frauds especially identity frauds are on the rise today in India. This loophole is exploited by the fraudsters to execute identity theft and other crimes against the person. The amended IT ACT 2008 also provides huge liabilities to organizations in case of any theft of confidential information or identity fraud.

It is advised that all organizations adopt the reasonable security measures not only to protect its sensitive data and customer’s data but also prevents the huge liabilities.
