SUPREME COURT SLAMS UP OVER LAND ISSUE

Supreme CourtThe Apex Court showed no mercy and was critical over the acquisitions of Uttar Pradesh government of an agricultural land to build luxury flats in Greater Noida and the biggest contention was the invocation of the “URGENCY CLAUSE” which barred farmed from raising objections.

The critical bench consisting of Justices P. Santhasivam and and A.K. Patnaik said, “Whose residential use are these flats for? Who is building them? What are the prices? We want to go into details of the case. This urgency clause is not automatically invoked…. We do not want more Nandigrams in all States.”

The court stated that it would prevent a similar situation which occurred in Nandigram and was also of the opinion what it would not remain isolated from this issue.

The petitions were filed by the Greater Noida Industrial Development Authority and real estate developers and builders, including Supertech and Amrapali, challenging the Allahabad High Court order that quashed the notifications for the land acquisitions in Greater Noida.

Moreover, the fact that high-cost residential flats were being constructed on invocation of urgency clause further annoyed the Supreme Court.
