Children born out of living relationship are not illegitimate-Supreme Court

illegitimate Child Considering a new approach into the living relationship of the people and the legitimacy of the children born out of that relationship, the apex court made a declaration that those children should not be regarded as illicit. The court also adds up in its ruling that these kids undoubtedly possess the right to inherit the property of either of their parents. The bench of Justice P. Sathasivam and B.S chauhan stated that a man and a women living together for a certain period of years under the same roof must be presumed to be husband and wife and children born to them in that relationship are not at all illegal or unlawful. The bench again stated that the law presumes in favour of marriage and against concubine and the relationship is regarded to be marriage as per law, if the partners keep their bonding alive for an elongated period of time.
