Interim injunction in Cadbury trademark infringement case

CadburyThe Delhi high court gave an interim injunction in favor of the chocolate giant Cadbury in a trade mark infringement case. Earlier an Indian company Lodha garments has been using the trademark Cadbeery, which is almost similar to this foreign chocolate brand Cadbury.  Cadbury chocolate has accused the Indian company of using its trade name deceptively and thus committing pass off.  Cadbury UK Ltd and its Indian subsidiary had moved the High Court accusing nondescript entity Lodha Garments of adopting a deceptively identical name to promote its product.

Data Protection Act in trouble

This Data Protection Act was passed by both the House of Parliament but then also it was not passed accordance with the majority to amend the constitutional rights as this Act was without the public consult or without the discussion of stakeholders before it was debated. Since this act was passed four months ago still the pollution is not informed about its rights or affected organization about their obligations.

People charged for Black Money to be tried under IT Act

Black_MoneyThe income tax department of India has started sending notices to those persons who are engaged in black money or money laundering. The notice is being sent by the directorate of criminal investigation as per the names received by the France of the persons having accounts in Swiss bank and having accounts in different countries. When it was asked with finance minister Pranab Mukherjee regarding the disclosure of names of these people then it was said that under the treaty with France the names will be disclosed only after the prosecution by the income tax department. The question whether the names includes politicians, industrialists, MPs? Remained unanswered.

Accused of Criminal Charges in Cricket History

Mohammad AsifPakistani cricketer Md. Asif, Salman Bhutt, and Amir Sohail, have been charged with criminal conspiracy and charges of cheating and found guilty by the jury in London.  This for the first time in the world cricket history that the players are facing such prosecution.  The issues cropped during the lords test previous year. When a bookie predicted a no ball and MD. Asif and Amir Sohail bowled no balls. And then they were caught under match fixing rules and tried under a jury in London. The final decision as to sentence of these players is yet to come from the judge.  And as a result ICC has imposed 5-7 years ban on them. Pakistani cricket is supposed to suffer a great setback due to this incident.

A milestone Act in the English Human Rights History

Human_RightsConsidered to be a landmark in the human rights history of UK, The Legal Aid, Sentencing and Punishment of Offenders Bill which was introduced to the Parliament on June 21st, 2011 reaches its third reading and report stage. The aim of the Bill is to create a more transparent and lucid justice delivery system for improving the rehabilitation rates and increasing the victim reparation levels. The third reading and report stage of the bill is scheduled to be done during the course of three days i.e. October 31st, November 1st and November 2nd. The proposed Bill comprises of four parts and 16 schedules dealing with legal aid, the cost of litigation and the punishment to be awarded to the offenders.

Preliminary Enquiry registered against DB Realty

Legal EnquiryThe Central Bureau of Investigation, as part of its investigation on the kickbacks -for-loans scam calculated around Rs.12,000 crore, registered a Preliminary Enquiry (PE) against the DB Realty on charges of availing loan without satisfying the eligibility rules. The DB Realty had supposedly availed loan of Rs. 300 crore without meeting the norms. The CBI had initiated the PE after examining the balance sheet of DB Realty that did not go with the real figures. It was found that numbers had been inflated through forged documents. During the investigation, the CBI has arrested many senior officials of public sector financial institutions and had also probed into the involvement of other benefited private companies.
